Roundup Weed Killer Lawsuits

Serving You and The State of Florida

Roundup, a weedkiller manufactured by Monsanto, has been used on millions of properties to maintain lawns and gardens. The chemical kills weeds by destroying the enzymes that regulate plant growth. Unfortunately, after years of consumer use, the weedkiller has now been linked to cancer. Even more concerning is the fact that the manufacturers, originally Monsanto, and more recently, Bayer, have known about the increased risk of cancer but have fought to cover it up.

Many individuals who have developed cancer after the use of Roundup are filing lawsuits against the manufacturer, alleging that their cancer is a result of the carcinogens used in Roundup. Glyphosate, the main chemical used in Roundup, is so widely used in weedkillers that studies show that a majority of the population has ingested it at some point in their lifetime through water, food, or dust.

What is Roundup, and what is the Problem?

Roundup is an extremely popular weedkiller made with Glyphosate. Glyphosate was developed and patented by Monsanto and was brought to market in 1974 under the brand name Roundup. Because Glyphosate was effective at killing weeds, it soon became synonymous with effective ways to control weeds in your lawn or garden.

The use of Roundup exploded after 1996 when Monsanto produced and sold genetically modified seeds to produce crops that are resistant to the effects of Glyphosate. So, the crops could be sprayed with Roundup without fear of damaging the crops while destroying weeds.

The use of Roundup increased again in the early 2000s. That was when the practice of “green burndown” was implemented on a large scale. The method of “green burndown” means saturating crops in Glyphosate shortly before harvest. The practice speeds up the harvest of certain crops such as wheat, barley, and beans. As a result, the crops that end up in your local stores probably have a high concentration of Glyphosate. Few studies have been carried out to determine the long-term effects of this type of secondary exposure to Glyphosate.

The patent on Glyphosate expired in 2000, but Roundup remains the premier weedkilling herbicide on the market. Worldwide, more than 300 million pounds of Roundup are spread each year. The problem surfaced that the chemicals in Roundup have been linked with lymphatic cancers such as non-Hodgkin’s Lymphoma.

The World Health Organization (WHO) has not come out and directly stated that Roundup contains carcinogens. However, they have noted that the chemical, Glyphosate, is “probably” carcinogenic.

A study conducted by the University of Washington found that Glyphosate increased the odds of non-Hodgkin’s Lymphoma by forty-one percent. In contrast, the US Environmental Protection Agency (EPA) drafted a risk assessment in 2017 that stated the herbicide “is not likely to be carcinogenic to humans.” The EPA, in August of 2019, refused to issue a mandate that the labeling on products that contain Glyphosate be mandated to include a warning that it is a known carcinogenic. The EPA went so far as to state that it was “a false claim.”

Recent court cases have revealed evidence that Monsanto spent years attempting to influence regulators, cover-up scientific research, and discredit critics of Glyphosate. Their attempts were largely successful, and lobbyists have used pseudoscience to appease government oversight committees.

The corporate giant, Bayer, purchased Monsanto in 2018 and similarly released a statement that same year that the chemical glyphosate was a “safe and efficient weed control tool.” Bayer backed their confidence with a $63 billion purchase of Monsanto, with full knowledge of the pending lawsuits it would inherit with the purchase. Think about that for a moment. Bayer spent $63 billion to buy a company, knowing it may have to pay out billions more in legal costs. It is safe to say Roundup is a moneymaker that does not seem to be going anywhere soon.

Bayer remains the world’s largest pesticide and seed company, but its stock lost nearly forty percent of its value with three court losses in a row. However, Glyphosate is the most widely used chemical in agricultural history. Farmers continue to rely on Roundup, and the growing population creates an explosive demand for food. Those facts continue to bolster investor confidence, and that confidence keeps Bayer from considering pulling Roundup from use.

What types of cancer are linked to the use of Roundup?

The carcinogenic effects of Roundup are not limited to non-Hodgkins Lymphoma. The chemicals in the herbicide have also been linked to Chronic Lymphocytic Leukemia (CLL), Small Lymphocytic Lymphoma (SLL), Follicular Lymphoma, Mantle Cell Lymphoma (MCL), Hairy Cell Leukemia (HCL), Burkitt Lymphoma and Cutaneous T Cell Lymphomas.

Lymphoma

You may be asking yourself precisely what Lymphoma is? Lymphoma is a cancer of the lymphatic system in the body. The lymphatic system includes the lymph nodes, thymus gland, spleen, and bone marrow. Lymphoma begins in the white blood cells, called lymphocytes, and is a part of the body’s immune system. Non-hodgkins Lymphoma is an umbrella term that covers numerous types of Lymphoma.

The first signs of most lymphomas include enlarged lymph nodes, weight loss, stomach pain, and fatigue. The treatment for Lymphoma almost always consists of radiation and chemotherapy, as well as a potential stem-cell transplant. Though advances have been made, the treatment for Lymphoma, like many cancers, is brutal.

It can take months of chemotherapy and radiation to reach remission, and the recovery from treatment is physically and emotionally taxing. Those who have survived lymphoma talk of the constant fear of a relapse, and though they attempt to return to normal life, they do so with the threat of a relapse hanging over them.

The medications used to combat cancer can leave lifelong side-effects, and that is assuming you are fortunate enough to achieve and maintain remission. Lymphoma kills approximately one-thousand people a year in the United States.

Like most cancers, Lymphoma is staged according to how far it has spread when the cancer is first diagnosed. The stage plays a significant role in the overall survival rate, as does the type of Lymphoma and how well you respond to treatment. Overall, the five-year survival rate is 71%, and the ten-year survival rate is 60%. The survival rate declines dramatically for stage four cancer.

What is being done to the manufacturer, Monsanto?

Once the link between Roundup and cancer was established, Monsanto is now facing thousands of lawsuits. These lawsuits are usually filed by farmers or laborers who used the herbicide regularly and were unaware that Roundup had potential carcinogens. To date, there have been three cases that reached a verdict, one of which was a verdict awarding the complainant $289 million.

To date, there are approximately 125,000 lawsuits in the United States which state that Roundup caused cancer. The new manufacturer, Bayer, has a potential deal in place to cover an estimated fifty to eight-five thousand lawsuits. The payout in these cases will range from a few thousand dollars on some to a few million on others. The company is rumored to be setting aside an additional $2 billion to cover claims which might arise from Roundup in the future, as well.

That’s right. The product is so profitable that the manufacturer continues to produce and sell the herbicide despite the known risks. As with all large corporations, money is the bottom line. That means it is more profitable for Bayer to fight or settle lawsuits than to halt the sale of a dangerous chemical.

What should you do if you have been exposed to Roundup and developed cancer?

If you were diagnosed with non-Hodgkin’s Lymphoma after using Roundup for an extended period of time, either at work or home, you should speak with an attorney who specializes in Roundup litigation. The Lopez Law Group is familiar with the ongoing litigation against Roundup and prepared to fight for a fair settlement if the carcinogen may have caused your cancer.

Unfortunately, there are thousands of people across the United States who have been affected by Roundup and are now facing the often dire consequences. The manufacturers should be held responsible for the injuries. If you, or anyone you know, was diagnosed with non-Hodgkin lymphoma and believe Roundup might have caused it, call the Lopez Law Group today. We can be reached at (727) 933-0015. Our attorneys are standing by to answer your questions, and our initial consultations are always free on these types of cases.

The manufacturer of this dangerous chemical has made the decision to continue the production of a chemical that has been proven to cause cancer, yet refuses to acknowledge the link. Though a settlement or winning a monetary award will not restore your health or erase the pain and suffering cancer causes, it can help hold them accountable for the damage they are continuing to cause with the sale of Roundup.

Hitting them in the profit margin is the only way to address the careless disregard for the toll this product has on the health and well-being of many who use it. Let the Lopez Law Group help you fight back against corporate greed that impacted your life.

"Awesome!"

Thank you Geoff Pfeiffer, for your assistance when my HOA pushed back on my installation of the Solar Panels on my home. Your succinct and eloquent statements of my rights to them turned a “solar panels are not allowed on the front side of the roof, to a 100% approval with no changes needed. Thank you for helping me quickly resolved what was gearing up to be a fight with the HOA.

“I Will Never Use Another Lawyer”

We couldn’t be more satisfied with Sean’s work and are so grateful we chose him to represent us. He works so diligently and tenaciously to get results, and somehow manages to combine being a consummate professional yet friendly and approachable. I was honestly terrified of receiving the final bill considering the hours upon hours he invested in our case (texts, calls, emails, meetings, etc.) after hearing nightmare lawyer stories from other people, but when I did I was shocked at how little he charged us. I never thought I’d say I wanted to pay somebody more than they charged, yet this time I did. I will never use another lawyer; we will use Sean for any and all representation we will ever need, and I urge others to do the same. Thank you, Sean!
